– The Fourth Report \u2013 <\/strong><\/p>\n

Growing abuse of freedom of expression and the escalating violence against journalists continue to go without an adequate institutional response.<\/em><\/strong><\/p>\n

The fourth report by the Slavko \u0106uruvija Foundation on the protection of freedom of expression in Serbia’s judicial system documents a continuing increase in the abuse of freedom of expression, disregard for the obligation of journalistic due diligence, and the increasingly frequent use of hate speech in pro-government media. At the same time, violence against journalists has reached alarming levels, particularly over the past year and a half and in the context of the protests.<\/p>\n

In the section examining the criminal law protection of journalists, the report shows that certain newsrooms have repeatedly been targeted by violence, threats, intimidation and obstruction of their work, yet the criminal complaints they file are not treated with the particular care such cases require. On the contrary, these complaints are often dismissed summarily and as a matter of routine.<\/p>\n

Criminal offences committed against journalists are frequently dealt with without due regard for freedom of expression or for the link between the offence and the victim’s journalistic work. This approach departs from the guidelines for prosecutors developed by UNESCO and the International Association of Prosecutors. Among other things, these guidelines call for a contextual analysis of the connection between the alleged crime and the victim’s media activities, both past and present. Taking the wider media environment into account when making decisions in proceedings concerning crimes committed against journalists could contribute to improving both the media environment and journalists’ safety by ensuring a more effective institutional response to the violence and threats they face.<\/p>\n

The report\u2019s analysis of criminal law protection afforded to journalists over the past two years shows that the competent authorities have failed to send a clear message that violence against journalists is unacceptable and will be met with appropriate sanctions. The failure of institutions to respond adequately to such violence encourages potential perpetrators and contributes to the further erosion of media freedom.<\/p>\n

The analysed civil proceedings conducted under the Law on Public Information and Media indicate a growing prevalence of sensationalist reporting, violations of honour and reputation, breaches of the presumption of innocence, and infringements of the right to privacy.<\/p>\n

The analysis of final judgments reveals significant differences in plaintiffs\u2019 success rates depending on the media outlet against which the proceedings were brought. In particular, a clear distinction can be observed between media outlets most frequently found by the Press Council to have violated the Journalists’ Code of Ethics and those with the fewest such violations. In the analysed cases brought against Informer, Kurir<\/em>, Alo<\/em>, Novosti<\/em>, Srpski Telegraf<\/em> and Republika<\/em>, the claim was upheld in whole or in part in 93.7% of the final judgments analysed. By contrast, the success rate of plaintiffs was significantly lower in cases brought against Danas<\/em>, Nova<\/em> and KRIK.<\/p>\n

The report also analysed the amounts claimed in damages, as excessively high claims may indicate the use of SLAPP lawsuits. It found that high damages claims (exceeding one million dinars) were more frequently brought against media outlets that rarely breach the Journalists’ Code of Ethics and that report critically on the government.<\/p>\n

One of the problems identified is the persistent repetition of the same violations by the same media outlets against the same plaintiffs, most commonly opposition politicians. The court cases analysed clearly show that certain opposition politicians have for years been subjected to sustained negative media campaigns in pro-government outlets. These outlets repeatedly publish articles containing identical or very similar allegations about the same individuals, without verifying the accuracy of the claims. This problem is further deepened by the low amounts of awarded damages, which are clearly not proportionate to the frequency and severity of the violations and therefore fail to have a deterrent effect.<\/p>\n

Judicial protection is neither sufficient nor effective enough to prevent violations of the rights protected in media-related civil proceedings or to improve media reporting standards.<\/p>\n

Serbia still lacks an effective response to the problem of SLAPP lawsuits, despite explicit warnings from the European Commission and the growing number of cases posing a serious threat to the work of investigative media, journalists and civil society organisations. Although numerous international standards exist and training for judges and prosecutors is occasionally provided, the absence of genuine political and institutional commitment continues to limit the effectiveness of efforts to protect freedom of expression from the misuse of judicial proceedings.<\/p>\n
